MUNICIPALITY OF ARRAN-ELDERSLIE
NOTICE OF ADOPTION OF
COMMUNITY IMPROVEMENT PLAN BY-LAWS
TAKE NOTICE that the Municipality of Arran-Elderslie Council adopted By-law 63-2023 to designate a Community Improvement Project Area in the Municipality of Arran-Elderslie.
AND TAKE NOTICE THAT the Municipality of Arran-Elderslie Council adopted By-law 64-2023 to adopt a Community Improvement Plan for the Community Improvement Project Areas in the Municipality of Arran-Elderslie and rescinded By-laws 37-2014 and 38-2014.
AND TAKE NOTICE THAT the purpose and effect of these By-laws is that the policies have been modernized to address the goals of the Arran-Elderslie Official Plan as well as create the enabling policy needed for businesses to access additional grants when available through Bruce County.
AND TAKE NOTICE THAT there were no public submissions received regarding this matter.
AND TAKE NOTICE THAT this Community Improvement Plan is exempt from approval by the Minister of Municipal Affairs and Housing and as such the decision by Municipality of Arran-Elderslie Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.
AND TAKE NOTICE THAT any person or agency who objects to By-law 63-2023 or By- law 64-2023 may appeal the decision of Council to the Ontario Land Tribunal (OLT), by filing with the Municipal Clerk, not later than January 2, 2024, a certified cheque or money order in the amount of $1,100.00. If an Appellant is a private citizen, registered charity or a non- profit ratepayers’ association, they may request the lower filing free of $400, if a request for the lower fee is made at the time of filing the appeal. Please use the OLT’s Request for Lower Fee Form at https://olt.gov.on.ca/appeals-process/fee-chart, payable to the Minister of Finance, Province of Ontario. A completed Notice of Appeal form setting out the reasons for the appeal of the By-law is required to be accompanied with the Ontario Land Tribunal fee. Appeal forms are available on the OLT website http://olt.gov.on.ca/.
Appeal Procedure:
If a person or public body would otherwise have an ability to appeal the decision of the Municipality of Arran-Elderslie to the Ontario Land Tribunal (OLT) but the person or public body does not make oral submissions at a public meeting or make written submissions to the Municipality of Arran-Elderslie before the update is adopted, the person or public body is not entitled to appeal the decision.
AND further, that if a person or public body does not make oral submissions at a public meeting, or make written submissions to the Municipality of Arran-Elderslie before the update is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal (OLT) unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
